Disha is an Indian Advocate and specialises in IP litigation. She has extensive experience in advising on trade mark disputes, trade mark filing and prosecution, domain name disputes, brand strategy and alternate dispute resolution in intellectual property rights matters. She is keenly involved in advising clients on the impact of proposed public policy and regulatory changes.

Disha has previously worked with a leading law firm specialising in Intellectual Property Rights. She has particular expertise in the areas of media, entertainment and news broadcasting; publishing and defamation; trade mark; information technology and intermediary liability. Disha has represented a diverse range of clients, from fledgling startups to established multinationals, ensuring their intellectual assets are safeguarded against infringement and misappropriation. 

 

Disha played an integral role on the road to the culmination of the landmark judgment on blocking of “hydra headed” rogue websites by the Delhi High Court, as part of the Global Anti-Piracy Campaign initiated by the film industry. Successively, Disha has maintained a track record of effective legal battles against piracy networks and illicit streaming platforms in the courtroom and beyond.

 

Disha also has experience with arbitration arising out of software licensing agreements.

 

Disha leads the Firm’s Intellectual Property Law practice.

  • UTV Software Communication v. 1337x.To, (2019) 78 PTC 375, a landmark decision granting a dynamic injunction to copyrightowners against rogue websites. 

  • Universal Studios LLC. & Ors. v. Vegamovies.run & Ors., CS(COMM) 265/2022, granting a dynamic interim injunction to copyright owners against rogue websites that are mere iterations of previously blocked websites and use known “pirate branding” to gain traction.

  • Universal Studios LLC. & Ors. v. 123movieshub.tc & Ors., CS(COMM) 116/2022, granting a dynamic interim injunction to copyright owners against rogue websites and observation on the question of joinder of parties, specifically in site blocking suits.

  •  Star Television Productions Ltd. & Ors. v. Eurosport & Ors., CS(COMM) 359/2020, granting an interim injunction order restraining use of the Star Mark in the suit for trademark infringement.

  • Star Television Productions Ltd. & Ors. v. Vaishali Saran & Ors., CS(COMM) 458/2018, granting permanent injunction against the infringing entities and directing the domain name registrar to transfer the domain names to the Plaintiffs in this suit for domain name infringement.
