Sidhant leads the Firm’s General Litigation, Insolvency and Data Privacy practice.

 

Sidhant is an Indian Advocate with a specialization in commercial litigation, including energy regulatory and insolvency matters. With vast commercial experience, Sidhant has regularly advised several corporations, both private and state owned, in a variety of legal disputes.

Sidhant represents clients in commercial suits and insolvency proceedings. Sidhant also has extensive experience in representing energy distribution and transmission companies before the Appellate Tribunal for Electricity and the Central Electricity Regulatory Commission.  

On the arbitration front, he regularly represents clients in arbitration-related court proceedings for the setting-aside of arbitral awards, appointment of an arbitral tribunal in India- seated arbitrations and seeking urgent interim reliefs. In 2022, he received his first appointment from the High Court of Delhi to act as a sole arbitrator in a dispute pertaining to a construction dispute.  

 

In addition, Sidhant specializes in advising on data protection, data flows, Telecom Media and Technology (TMT) regulation and intermediary liability. He has advised leading Indian and multi-national consumer facing businesses on compliance with applicable data protection laws. 

 

Prior to establishing his practice in New Delhi, Sidhant worked at a white-shoe US based firm – Gibson, Dunn and Crutcher, in its Singapore office. 

  • Airtel Payments Bank Ltd. v. Com Vision (India) Pvt. Ltd.: Representing the petitioner in pursuing a challenge to an arbitral award passed in contravention to the express terms of the contract.

 

  • Dalmia Family Office Trust v. Getamber Anand:  Successfully acted for the petitioner in this case where the High Court of Delhi held for the first time that criminal contempt proceedings are maintainable for misconduct during arbitral proceedings.

 

  • ANI Media Pvt. Ltd. v. Matchbox Shots LLP & Ors.: Represented a media outlet in pursuing its rights against Netflix and the producers of the series IC 814: The Kandahar Hijack for unauthorised use of the media outlet’s proprietary footage.

 

  • ANI Media Pvt. Ltd. v. OpenAI OPCO LLC: Representing a media outlet in this first of its kind intellectual property suit for unauthorised use of copyrighted content by Artificial Intelligence platforms.

 

  • ANI Media Pvt. Ltd. v. Wikimedia Foundation and Ors.:  Acting for the plaintiff in this defamation action brought against Wikipedia, an online encyclopaedia.  The matter involves key issues concerning online intermediaries, locus and the scope of the safe harbour defence.

 

  • Pranav Ansal v. Vistra ITCL (India): Successfully represented a debenture trustee in setting aside proceedings before the High Court of Delhi, in which the Court affirmed an arbitral award of INR 1.8 billion.

 

  • X v. Union of India: Acted as second chair to the Amicus Curiae to assist the High Court of Delhi in adjudicating the obligations of online intermediaries to remove offending content without insistence on specific web addresses.

 

  • Asian Hotels (North) Ltd. v. Alok Kumar Lodha: Successfully argued before the Supreme Court that it is impermissible to amend a suit to change the nature of the reliefs sought and impleading non-signatories to the suit, to resist reference to arbitration.

Dispute Resolution & Insolvency

Data Protection, Cybersecurity & Public Policy Advisory

  • Advised a newly established aviation  company on legal issues related to privacy and cybersecurity including devising consumer data protection practices for data storage, use and security along with preparing privacy policies and terms of use for its websites and mobile applications

  • Assisted a leading aviation company in relation to legal issues arising out of data breach incidents and preparation of related filings with governmental authorities and internal investigations

  • Advised a large consumer technology corporation on its public policy advocacy strategies concerning legislative and other policy proposals in areas such as intermediary liability, data protection, legal metrology and foreign exchange control regulations. 

  • Advised a popular caller-identification mobile application in relation to compliance with data protection laws, intermediary due-diligence requirements, preparation of policies for advertisers and advertisement content moderation.

  • Advised a leading streaming service in relation to legal and regulatory issues related to content moderation and preparation community standards and related terms of use

  • Advised the global policy team of a leading music streaming service on expected legal and regulatory changes related to digital payments, data protection, content moderation, intermediary liability and regulation of political speech

  • Prepared a comparative analysis of the Personal Data Protection Bill and the European Union’s General Data Protection Regulation on behalf of an industry association of smartphone manufacturers and owners of mobile applications

  • Advised the technical, business and legal teams of a leading Indian telecommunication corporation on the compliance requirements under the Personal Data Protection Act, 2023 in relation data collection, storage, use, disclosure and security and devise business preparedness strategies

  • Advised chambers of industry in relation to preparation of its response to stakeholder consultations held by the Government India in relation to the Personal Data Protection Bill, 2019 and proposed changes to the intermediary due diligence requirements
